    over sex e-mails to boy, 16

REPUBLICAN Party leaders in the United States faced calls for an inquiry yesterday amid accusations they turned a blind eye to a Florida congressman who sent sexually explicit e-mails to a 16-year-old boy.

Mark Foley, 52, a deputy Republican whip, resigned last Friday following the revelations. Since then, it has emerged that he shared a series of salacious communications with at least two other messenger boys who worked on Capitol Hill.

Dennis Hastert, the Republican speaker of the House of Representatives, yesterday condemned Mr Foley's actions as "abhorrent" and "an obscene breach of trust", adding: "His immediate resignation must now be followed by the full weight of the criminal justice system."

But it has emerged that Mr Hastert was told about some of the e-mails months ago by congressman Thomas Reynolds, chairman of the Republican national congressional committee, who failed to pursue the matter.

The scandal has rocked Capitol Hill and left the Republican Party scrambling to limit the damage just weeks before the congressional elections, where they face losing their majority.

"Congressman Reynolds's inaction in the face of such a serious situation is very troubling and raises important questions about whether there was an attempt to cover up criminal activity involving a minor to keep it from coming to light before election day," said Karen Finney, spokesman for the Democratic national committee.

It emerged that several other members of the Republican leadership - including the House majority leader, John Boehner - also knew of the messages.

Mr. Foley could now be prosecuted under laws he helped enact as chairman of Congress's missing and exploited children's caucus, a role in which he often vowed to root out child predators.

sick they are....and the presidents press secretary is poo-pooing this as just naughty E-mails...wake up people...the Republicans don't have your best interests in mind any more than they did the 16 year old pages that they knew were being harrassed by the sicko among thier ranks. (Comment this)

2 - Teenagers are not children. The law says as much in almost all countries where age of consent is typically 14-16. The indidividual states as well have lower ages of consent than the federal govt uses to define a “minor” for internet/telephone contact. Even in DC, age of consent is 16.

In fact Foley did not commit a crime, because the age of consent in the jurisdiction is 16. Federal solicitation charges depend on the laws of the jurisdiction. There's no indication that he offered to pay for sex. Sexual harassment is also an unlikely charge because the page in question was not in his emply. (Comment this)

3 - Oh, you're talking about Foley and SEX. But why, why, why such a sexual "CONSENTING" defense Jake? I do believe RAPE has no age limit, nor does stalking and the blatant STUPIDITY that Foley has displayed. Your defense using "consent" is totally absurd,..unless you know something that you aren't telling us. Are you implying that Foley has had Sex with these teenagers/children with or without their CONSENT? Foley did what he did and has resigned for doing it,...what do you have to say about that, JAKE? And if you really know what you are talking about Jake, let's revisit the crimes in Omaha, Nebraska made by our so called Republican leaders and a few so called religious men of faith. You obviously want to open up a can of worms. Their is no defense for what Foley has done. It's called SICK,..Jake. (Comment this)

5 - If Foley didn't commit a crime then why is the FBI investigating?
So Jake, what you are saying is that sexual harrassment is OK as long as the victim/victims has reached the age of consent??? That's weak Jake....really weak...and totally wrong! But it is not surprising...Republican types will turn a blind eye to high crimes and misdemeanors as long as they are committed by Republicans. I guess that explains how Bush has a approval rating above 1%. (Comment this)

6 - jake, You are dead-wrong Jake. Officials say the FBI and Department of Justice lawyers are trying to determine how many such e-mails were sent, how many different computers were used and whether any of the teenage victims will cooperate in the investigation.

Notice that they use the word "VICTIMS"? If no crimes were committed why would they use the word "VICTIMS"?

The irony that everyone is missing is that it's possible Foley could be prosecuted under laws he helped to enact as the co-chairman of the House Caucus on Missing and Exploited Children.

Look it up Jake and become an "educated" voter and quit drinking the Kool-aid for once! (Comment this)

7 - Wow Jake...I can't believe someone is trying to defend Foley's actions by arguing that teenagers are not children. Even if that argument were true, which it isn't, luring any individual, including a child, by knowingly persuading, inducing, enticing or coercing any person to engage in sexual activity that constitutes a criminal offense violates federal law.

An example of luring would occur if an adult found a child in a chat room and used email correspondence with the child to persuade the child meet him with the intent that the child engage in sexual activity.

Even if the child in this example did not have to cross a state line to meet the pedophile, the pedophile could be prosecuted under federal law if the computer server used in the email was located in a different state.

8 U.S.C. § 2422(b):

Whoever, using any facility or means of interstate commerce knowingly persuades, induces, ENTICES any individual who has not attained THE AGE OF 18 YEARS, to engage in any sexual activity for which any person can be charged with a criminal offense, or ATTEMPTS to do so, shall be fined under this title and imprisoned not less than 5 years and not more than 30 years. (Comment this)
